Data protection is very important to us, especially when children are concerned. Therefore, we only use personal data to make our game even better. Please read on to find out exactly what this means.

1. Controller

1.1 As the operator of the mobile app "Stage Fright Monsters" (hereinafter: "App") Nerd Communications GmbH, Zehdenicker Str. 12C, 10119 Berlin (hereinafter: "we") is responsible for the processing of personal data of users (hereinafter: "You") of the App within the meaning of the General Data Protection Regulation ("GDPR").

2. Processing of personal data

2.1 When using our App, we collect the necessary personal data described below in order to enable the use of the functions. If you do not provide us with this information, you will not be able to use the App or certain parts of the App.

(a) For the use of the App by you, we use your advertising ID (a unique code of the operating system of your mobile phone) to identify you when using the App (Art. 6 para. 1 lit. b GDPR).
(b) Furthermore, we collect the following data in order to offer and improve the functions of the App and to guarantee its stability and security (Art. 6 para. 1 lit. f GDPR):

  • Date, time and duration of the respective user's use of the App;
  • Time zone difference to Greenwich Mean Time;
  • Content of the request (specific content accessed);
  • Access status of the individual contents;
  • Quantity of transmitted data in each case;
  • Operating system and its interface, including language settings;
  • Version of the App.

2.2 When downloading the App, the technically required information is transmitted to the App Store, in particular the user name, e-mail address and customer number of your account with the respective App Store provider, the time of download and the individual device code number. We cannot influence this data collection. We process data only to the extent necessary to download the App to your device. (Art. 6 para. 1 lit. b GDPR).

2.3 We process your personal data in order to fulfill our obligations arising from an agreement concluded between you and us (Art. 6 para. 1 lit. b GDPR), in particular if you make use of paid services within the App. With certain agreements we are obligated to store your payment data according to the legal requirements. (Art. 6 para. 1 lit. c GDPR).

2.4 When you contact us (e.g. via our contact information mentioned above, see item 1), we process the personal data provided by you (e.g. your name and e-mail address) to answer your questions (Art. 6 para. 1 lit. b GDPR).

2.5 We do not use any automated decision-making including profiling.

3. Recipient

3.1 In order to be able to offer the App securely and continuously improve it, we transmit your personal data to the analysis service Unity Technologies, Inc., 30 3rd St, San Francisco, CA 94103, USA ("Unity"). We have concluded a processing agreement with this processor so that the personal data is processed strictly in accordance with our instructions. Unity is headquartered in the USA. You can request a copy of the suitable or reasonable guarantees for this transfer from our data protection officer (see item 1.2).

3.2 In order to process payments for in-app purchases, we transmit your personal data necessary for the execution of the payment to the respective platform provider.

3.3 Otherwise, we only transmit personal data to the extent that we are obligated to do so by law or official or court order.

4. Storage period

We process the personal data only as long as it is necessary for the purposes mentioned and delete it afterwards or – in case of legal retention periods – limit the processing.

5. Your rights

5.1 You have the following rights toward us regarding personal data concerning you according to the legal provisions:

  • Right to information;
  • Right to rectification and deletion;
  • Right to restriction of processing;
  • Right to data portability;

5.2 Where the processing is based on Art. 6 para. 1 lit. a GDPR, you have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

5.3 You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on Art. 6 para. 1 lit. a GDPR, including profiling that may be based on those provisions. We will no longer process your personal data in this case, unless we can claim compelling protectable reasons for the processing that have priority over your interests, rights, and freedoms or unless the processing relates to the establishment, exercise, or defense of legal claims.

5.4 Moreover, you have the right to lodge a complaint with a data protection supervisory authority about our processing of your personal data.
